论纺织行业反倾销自律活动中的垄断法律风险及其克服

我国纺织业出口的过度无序竞争吝易引来反倾销指控，但如果行业自律演变为联合限价限产等，也可能构成反垄断法上的横向联合限制竞争行为。近年来我国出口企业已开始遭到反倾销和反垄断指控的前后夹击。要在法律上应对这一挑战，切实维护我国纺织出口企业的利益，首先需要在宏观层面上立足WTO框架，以竞争为导向来协调反倾销法和反垄断法之间的冲突；其次要在我国反垄断立法中规定本国出1：2卡特尔的豁免制度；最后要以反垄断法的视野来重新审视纺织行业协会的功能定位与作用方式。
