摘    要:公共性是现代教育的基本属性,它要求国家主动干预,维护公共利益;要求国家财政支持,改善整个社会的教育条件;要求以社会为本位,维护每一个人的平等受教育权。由于传统法律部门难以回应教育公共性凸显所反映的社会要求,教育法应运而生,成为维护教育公共性的一个理性选择。2002年之前的教育立法,整体看是为了实现改革目的、实现"以法治教"而制定的法,缺乏与教育内在价值的呼应,不能发挥社会所期待的、应有的功能,在前期教育改革中出现了一些新矛盾、新问题,导致了教育的公共性危机。当下,教育立法必须回归教育的公共性,以教育的公共性为教育立法的核心价值基准,教育法各要素的规范也须考虑公共性的要求。

Abstract:Publicity is the basic attribute of modern education.It needs national active intervention to maintain public interests.It needs national financial support to improve the educational conditions of the whole society.And it needs to take the society as the foundation to maintain the right of education for every individual.Because traditional legal department cannot meet the social requirement of educational publicity,educational law emerges as the time requires and it has been a rational choice.From the overall perspective that educational law aims to implement the purpose of reform and administer school and teaching with law before 2002,it cannot give full play to its internal function as the society expects the deficiency of response to the intrinsic value.As a result of the new contradiction and problems at the prior period of education reform,the crisis of educational publicity appears.Educational legislation should therefore respond to the educational publicity in the "after-education reform Times" and educational publicity should be taken as value standards of educational legislation.
