评美国国会图书馆的DVD技术措施例外条款——兼论我国著作权法例外条款的完善

2010年,美国国会图书馆颁布了6种规避技术措施例外情形,例外情形之一为规避DVD技术措施例外。规避DVD技术措施例外使社会公众可以基于评论、教育、拍摄记录影片、制作非营利影视作品的目的规避DVD影片上的技术措施。但是,该项例外适用条件严格,适用范围狭窄,无法妥善解决DVD影片使用上著作权人和社会公众之间的矛盾。我国著作权法中有关技术措施的立法应吸取美国国会图书馆的经验与教训,完善技术措施例外类型,确定合适的例外情形适用范围,确保技术措施例外规定发挥其应有功效。

Review of the DVD Technical Measure Exception Clauses in the US Library of Congress Study on the Improvement of Exception Clauses in Copyright Law in China

In 2010,the US Library of Congress has promulgated six kinds of circumvention of technical measure exceptions.One of exceptions is the circumvention of DVD technical measure exceptions.The circumvention of DVD technical measure exceptions allows the public to circumvent technical measures on the DVD movies which are based on comments,the education,shooting documentary films,producting non-profit films.But the exception has the strict applicable condition and narrow applicable scope,is unable to properly solve the contradiction on using DVD movies between copyright owners and the public. The Copyright Law in China related technical measures should learn the experience and lessons of legislation from the US Library of Congress,perfect types of technical measures,determine the right applicable scope of exceptions,and ensure technical measure exceptions realize its efficacy.
