行政指导概念的重界定

行政指导作为一种必不可少的行政方式，其在实践中表现出的问题使得对之进行深入的理论研究很迫切，而首要的问题是其定义问题。本以现有的观点为基础，首先探讨设置行政指导这样一个概念的可行性和必要性；接着分析现有的行政行为与事实行为之分的不科学性；最后在对行政主体行为进行新的分类的基础上将行政指导定义为：行政指导是一个类概念，是行政主体单方作出意思表示，行政相对人有权自由选择采纳、接受与否的一类行政主体行为。

Redetermining Definition of Administrative Guidance

As a necessary kind of agency action, the administrative guidance has manifested many problems in its operation. Therefore it is urgent to make theoretical study about it, and the first task is to give a definition to it. Based on the existing opinions, this paper first explores the feasibility and necessity to set such a legal term, and then discusses the unsuitability to divide the agency action into juristic act and factual act and to the latter the administrative guidance is regarded as subordinated. Finally, based on the new classification of the agency action, the administrative guidance is defined as a kind of agency action, though which the agency express its will or some information and the private has the freedom to decide to adopt it or not.
