| 摘 要： | 污点证人的豁免制度,对控检方来说,有助于实现真正的正义,提升诉讼的效率;对嫌疑人而言,有现实的豁免利益、必要的保障.参与方对彼此信任的考量、博弈层次的限制,促使控检方和污点证人形成理性、合理的双赢博弈结构.

| Abstract: | For the prosecuting party,the exemption of the witness for their guilty interrogation is available to a true justice and a promotion of the efficiency of lawsuit,while for the suspect,it is not only a true remission and an esstial assurance.The participants' considering of one another and the limitation in the game playing urge both parties of the prosecuting and the suspect to reach a rational and reseasonable con-wim. |
