对当下物权习惯法的研析

物权习惯法作为保证少数民族地区社会秩序稳定的民族习惯的一个部分,也是物权人在行使物权的过程中免除他人侵犯自身合法权益的一种保障性规范。物权习惯法通过大量不成文的规定可以引导少数民族人民应当从事或是禁止何种行为,这体现在物权习惯法具有法的一般作用,主要是指引、评价、教育、预测、强制人们进行财产的流转即物权变动行为。我国对少数民族习惯法的调查始于建国初期,其涉及我国各民族的物权习惯法,譬如所有权、使用权、租佃等内容,但至今无论在物权立法还是司法领域,少数民族地区物权习惯法的内容还存在诸多的问题,这对物权习惯法实际作用的发挥产生阻碍。于此,对我国当下物权习惯法的系列法律问题有必要深一步地进行研究,首先对我国物权习惯法的基本理论和缘由进行阐述,其次对我国物权习惯法的现状进行分析,最后提出当下物权习惯法的系列问题和相关完善措施。

Study and Analysis of Current Common Law of Real Rights

As a part of national custom of guaranteeing social stability of ethnic minority area,common law of real rights is a guaranteeing specification of real right holder exempting others from infringing one's own legitimate rights and interests in the process of executing real right.Through a great number of regulations,common law of real rights can guide ethnic minority people to perform or ban some behaviors,and has common role of law,to guide,evaluate,educate,predict and compel people to transfer real right.The investigation about common law of ethnic minority started in the beginning of the founding of the People's Republic of China,involving common law of real rights of every ethnic minority in our country,such as ownership,right of use,and tenancy,etc.At present,no matter in the fields of real rights law or judicial aspect,there are many questions in the content of common law of real rights in ethnic minority area,which hinders the implementation of common law of real rights.Therefore,further study on common law of real rights is necessary,firstly,to elaborate basic theory and source,secondly,to analyze the current situation,and finally to put forward some corresponding measures.
