| 摘 要： | 控权平衡论从控权、制衡角度来阐述行政法的基本理论。本文以行政法的价值和目标为基点,从行政权的良性和恶性两个方面来分析行政机关和相对人权利义务不平衡的事实,进而论述新的平衡理论,即追求公共利益和个人利益最大化的平衡。

| Abstract: | Power-control equalization theory explains the basic theories of administrative law form the angle of power-control and equalization. Taking the value and aim of administrative law as the starting print and from the benignancy and malignancy of administrative power, the article analyzes the fact of inequalities in rights and obligations between administrative organ and relative person as a departing point for the new equalization theory. This theory seeks the maximum of both public interests and individual interests. |
