| 摘 要： | 正确认识行政自由裁量权是规范行政自由裁量权的必要条件。从成文法的局限性和行政事务的层面来看,行政自由裁量权的存在有其合理性,但从它的"自由"属性、实体法的不足、程序法的不足和行政执法过程中非法律因素的影响来看,行政自由裁量权又很容易被滥用。

| Abstract: | It is a prerequisite to understand the free judgment right in order to standardize the administrative free judgment. From the point view of the statute law and civil service, the administrative free judgment has its rationality, but from the attribute of its "freedom", and the shortage of entity law, procedure law, and the illegal factors in executing the law, free judgment may be easily abused. |
