| 摘 要： | 产权式商铺是将大型商场分割成众多小商铺进行出售的。产权式商铺近年来成为一种重要的商业投资热点。但是,产权式商铺在法学理论中如何对其定性仍然是一个盲点,在立法制度上产权式商铺如何规制更是空白。于是,实践中,对产权式商铺如何进行产权公示和登记成为难题。由此,对产权式商铺法律性质的探讨成为必要。笔者认为,产权式商铺是一种特殊的建筑物区分所有权,并且是对建筑物区分所有权理论的发展。

| Abstract: | Property shops come into existence by dividing large-scale markets into small ones to sell merchandise,which have also become an important focus of commercial investment in recent years.Whereas,how to definite its character is still a blind spot in juristic theory and it is a blank area in legislative system.Therefore,it is difficult for property proclamation and registration in practice and thus necessary to make a discuss on the legal character of property shops. |
