在社会发展的不同阶段,国家对知识产权制度的不同需求导致了知识产权立法精神的不同。在萌芽时期,其强调的是国家利益;在产生、发展阶段,其强调的是个人利益;在完善时期,其强调的是社会利益;而现阶段,其强调的是全球利益。在知识产权法发展的不同发展阶段,其立法本位存在不同的问题。

Reflection on the Development Course of Intellectual Property Law

In different periods of social development,the country’s different demands on intellectual property rights have caused difference legislation standards to intellectual property system.In the germination period,its spirit is the national interests;In the development phase,its spirit is individual interests;In the consummation time,its spirit is the social interests;But at this stage,the emphasis is on global interests.This paper will review intellectual property law at the development of different stages,so as to be helpful of intellectual property rights legislation in future.
