| 摘 要： | 2007年10月1日出台的《物权法》明确了拆迁应予补偿及补偿原则,这有利于被拆迁人权益的保护。但是,《物权法》在保护被拆迁人利益方面尚存在诸多不足。为了更好的保护被拆迁人的利益,2011年1月21日,国务院正式公布了《国有土地上房屋征收与补偿条例》,此条例对城市房屋征收进行了规范,明确了基于公共利益方得实施搬迁。
