| 摘 要： | 在我国的司法实践中，大量的已成立合同被作为无效合同处理，新合同法将合同的效力单列一章，也未能有效解决这一问题；为保障交易安全，提高交易效率，本文试图从理论上探讨合同有效推定的可能性，以期促进司法的公正。

| Abstract: | A great deal of established contracts hav e been handled as invalid con tracts for a long time in judicial proceedings. Therefore the validity of the co ntract was stipulated in a specific section in the newly-promulgated Contract La w to solve this problem; however, it proves to be failed. This article is an app roach to the possibility of accepting the theory that a contract could be constr uced as a valid contract after it is legally established in order to maintain th e safety in transactions and heighten the transaction efficiency. |
