摘    要:教师职业的公共性源于教育的公共性和学校的公共性,教师权利及其界限的确立应以教师职业的公共性为基本价值。应当在确定不同类型教师法律身份的基础上,依据教师的公务性、专业性特征,具体规定教师不同性质的权利及其限度。

Abstract:The publicness of teacher profession comes from the publicness of education and school,so it should be the basic value of the rights and obligations of teachers.Our legislation should stipulate definitely the different rights and obligations of teachers according to the characteristics of teacher profession.
