志愿者组织主体资格法律规制研究

志愿者组织在我国社会保障体系的完善以及市场经济中道德重建方面起着重要作用,而我国目前对志愿者组织在法律上缺乏统一界定,并且没有关于志愿者组织主体资格的具体法律规定,仅能从国务院颁布的《社会团体登记管理条例》和《民办非企业单位登记管理暂行条例》中找到相关规定.厘清志愿者组织的法律主体资格,并完善对其主体资格的相关规定,有利于维护志愿者组织及志愿者的合法权益,促进志愿者组织和志愿服务的健康发展.

The Legal Regulation of the Subject Qualification of the Volunteer Organizations

Abstract:The volunteer organizations play an important role in the improvement of China’s social security system and the restoration of morality under the circumstances of market economy.However,there is no unified definition of volunteer organizations in China and the subject qualification of volunteer organizations has not been clarified by law.Some relative provisions can only be found in Regulation on the Registration and Administration of Social Organizations and Provisional Regulations for the Registration of Non-enterprise Organizations Run by Local People,both of which were enacted by the Central Government.Therefore,it is necessary to clarify the qualification of legal subject of volunteer organizations and improve the related stipulations so as to protect the legitimate rights and interests of volunteer organizations and volunteers.In this way,the sound development of volunteer organizations and voluntary services will be guaranteed.
