涉外知识产权诉讼中长臂管辖的影响与应对

长臂管辖依托国内法规触角管辖境外实体,实质上突破了传统属地管辖和属人管辖原则,但作为适应互联网时代发展的产物,其也具有一定的合理性与必然性。在当前国际环境驱动下,我国应当坚决反对损害他国主权和合法利益的长臂管辖行为,同时在必要情况下应当实施适度的域外管辖行为,以应对关乎本国利益的涉外知识产权案件。在国家层面逐步建立和完善适度且合理的"域外管辖"制度;在国际层面积极引导国际标准机构制定和修改相关知识产权政策;在企业层面要求其增强风险识别和处理能力,在诉讼中主动援引相关法律和民事司法制度上的制衡规则进行合理抗辩。

Influence and Countermeasures of Long Arm Jurisdiction in Foreign-Related Intellectual Property Litigation

The long arm jurisdiction relies on domestic laws and regulations to govern foreign entities,which in essence breaks through the traditional territorial jurisdiction and the principle of personal jurisdiction.However,as the product of adapting to the development of the Internet era,it also has certain rationality and inevitability.Driven by the current international environment,China should firmly oppose prejudice the legitimate interests of other countries'sovereignty and long arm jurisdiction,at the same time if necessary should implement moderate behavior of extraterritorial jurisdiction,in response to their interest in foreign-related intellectual property cases,at the national level,gradually establish and perfect our country long arm jurisdiction countermeasures,make full use of the principle of"international comity","the principle of due process of law"and other constraints to specific charges.At the same time,at the international level,we should strengthen cooperation and actively guide international standards bodies to formulate and revise relevant intellectual property policies.At the enterprise level,it is required to enhance its risk identification and handling capacity,and take the initiative to invoke the relevant laws and the rules of checks and balances in the civil justice system to make reasonable defenses.
