| 摘 要： | 我国债权人代位权制度既传承了传统代位权制度，又对传统代位权制度进行了扬弃和创新，体现了中国社会主义的立法特色。但我国代位权制度仍有不少缺失和漏洞。从我国现有代位权制度出发，对其中的若干理论问题进行深入探讨，是完善我国代位权制度的迫切需要。

| Abstract: | The system of subrogation right of creditor in our country embodies the distinguishing feature of Chinese socialistic legis-lation.It succeeds traditional system of subrogation right;and it also sublates and brings forth new ideas.However,there arestill many depletions and leaks.Starting from existing subrogation system in our country,to study in-depth several theoreticalproblems in it is the urgent need for perfecting subrogation system in our country. |
