案例指导制度的中国特色问题

目前学术界对案例指导制度重视有余，而对其中国特色关注不足，这不仅给国际司法经验交流带来不便，而且导致了理论研究中很难就一些基本问题达成共识。案例指导制度的中国特色或者中国特色案例指导制度的特质，实际上包含国情之所在、特征之所在两个基本点。在比较分析的基础上，案例指导制度的中国特色可以概括为三点：一是其功能定位是法的适用而非法的创制；二是其形成机制是推荐和遴选机制而非司法审判；三是其作用方式是“应当参照”而非“遵循先例”。

Chinese Characteristics of Case Guidance System

At present ,the academia attaches great significance to the case guidance system ,while it pays much less attention to the system's Chinese characteristics .The lack of academic interest on this topic has not only hindered international exchanges of judicial experience ,but also resulted in much difficulty to reach consensus on some basic issues about the concept .The connotation of the Chinese characteristics of our case guidance system is national conditions and the qualities .On a basis of comparative analysis ,the Chinese characteristics of the case guidance system can be summarized in three points .First ,the function of the case guidance system is the application of law rather than the creation of law .Second ,it is a process of recom‐mendation and selection rather than the legal proceedings of trial .Third ,the approach is “should consult”instead of “stare decisis” .
