人事诉讼程序建立之商榷

人事诉讼纠纷涉及婚姻家庭的和谐稳定，具有较强的公益性，大陆法系国家普遍确立了人事诉讼程序来解决人事纠纷，以示国家之重视，而我国尚未确立一项专门解决人事纠纷的诉讼机制和程序。随着我国司法改革的发展，越来越多的学者认为我国应适应这一趋势，构建我国人事诉讼程序。而笔者不以为然，认为我国在原有的制度基础上加以完善即可达到与建立新的人事诉讼程序同样的效果。
