| 摘 要： | 我国的《国家赔偿法》实施八年来,由于立法本身存在的缺陷,妨碍了国家赔偿制度功能的发挥。本文从分析《国家赔偿法》立法存在主要问题入手,提出完善《国家赔偿法》的立法建议。

| Abstract: | The functions of "Law of the People's Republic of China on State Compensation" are hampered due to the legislative defects in itself, although it has been come into force for eight years. In this paper the author makes proposals for improving the Law based from the analyses to the principal problems in the legislation of the Law. |
