行政歧视之解析

摘    要:公共事务的管理就是公共部门通过公共政策的制定与执行承担公共责任的过程。而行政歧视是指以政府为核心的公共部门运用公共权力在公共事务的管理过程中,对行政对象作出超过必要度的不符合行政公正的行政行为。行政歧视不同于一般的社会歧视,行政歧视往往因其本身的特殊性,而具有严重的社会危害性。公共政策制定与执行过程中的行政歧视是其基本体现。因此,弄清行政歧视的概念、特征、类型及其基本体现是进一步深入研究行政歧视,从而提出科学对策的前提和基础。

Abstract:Public affairs' management is the process in which the public organizations execute and undertake the public responsibilities through formulating public policies;the administrative discrimination is an administrative action that the Public sectors mainly take the government as the core and utilize the public power in managing the public affairs,but the action surpasses the necessity for the administrative object and does not conform to the administration justice.The administrative discrimination is different from the general social discrimination.The administrative discrimination having its own particularities often does serious harm to the society.Administrative discrimination in the community policy formulating and implementing is its basic reflection.Clarifying the concept of discrimination,the characteristics,classification and basic reflection is helpful in furthering in-depth studying administrative discrimination,thus we can put forward the premise and basis of scientific measures.
