司法中的以人为本及其法律问题

以人为本的理念对我国司法过程产生了重要影响。人们在宣传和赞许以人为本时,往往只看到＂以人为本＂在法学领域好的一面,而忽视因理解、操作不当等原因导致的司法不公。司法中的以人为本在一些案件中并不是真正的以人为本,而是我国司法的思维方式——可接受性的反映。司法中存在的问题,可以采取超越司法,在社会其他领域解决,从而达到多方共赢的局面。

Human Orientation in Judiciary and Legal Issues

The notion of human orientation has generated important influence to China＇s judicial process.When spreading and praising the notion of human orientation,people often notice its beneficial aspect in the field of law,neglecting the judicial partiality due to improper understanding and inadequate handling.In some cases,judicial human orientation is not actually so,but the reflection of acceptability——-the thinking mode in China＇s judiciary.The problems existed in judiciary may be solved by transcending judicial field in other social field to realize the result of wining by all parties.
