| 摘 要： | 毛泽东新民主主义司法思想的理论基点是阶级统治的手段和具有特定国家机构职能的独立价值。它蕴含了坚持刑事法律适用平等的原则、坚持在刑事司法程序中“废止肉刑，重证据不重口供”、坚持少杀、严禁乱杀的刑事政策、反对丑恶的封建司法、司法注重社会效果等具体内容。毛泽东新民主主义司法思想观具有司法传统型归属性、司法人民性的定位等特点。
