人民陪审员制度改革试点新问题研究

借鉴国外陪审制度经验基础上建立的中国特色人民陪审员制度,长期陷入"陪而不审"之尴尬局面。人民陪审员制度改革迫在眉睫。在此背景下,不少地方法院改革试点大陪审制合议庭制度。虽然取得一定成效,然而多数改革存在陪审员定位偏差,履职积极性不高,责任机制缺失,与现行合议制相冲突的问题。解决这种困境的关键在于做出相应的程序设计,具体包括:陪审员的选任机制的完善、保障陪审员充分履职,构建合议庭责任机制以及改进合议庭细则,以实现人民陪审员制度的真正价值,推进我国合议庭制度改革,以期推动司法体制改革良性发展。

Analysis on the New Problems of Jury System

By learning the experience of the Jury system,China has developed the People Jury System as the current jury system,which now is in an embarrassing situation,and it is urgent to reform the system. But in the trial,there still are many problems. In order to realize the true value of jury system and promote the smooth progress of the reform,we should pay more attention to perfect trial basis approaches and the courts. Certain steps should be taken,such as the improvement of the Juror's selectin,ensuring the Juror conscientious,the collegial panel accountability mechanisms,and the improvement of the collegial panel regulations,etc.
