关于仲裁裁决撤销的一点思考

仲裁是依照当事人意思自治原则,将其间发生的争议交由仲裁机构解决的一种便捷、高效的处理纠纷的方式。仲裁法规定了撤销裁决和不予执行裁决两种司法监督方式。但在实践中,由于仲裁裁决的撤销制度问题重重,以至学界对于取消该制度的呼声越来越高。文章就此对仲裁裁决撤销中存在的问题作一简要分析,并提出相应的对策。

Opinions on the Cancellation of Arbitration Verdict

Arbitration,asking for the arbitration institution to solve disputes,is an effective and efficient way of handling conflicts.The arbitration law offers two judicial supervision approach including cancellation arbitration and implement denied.However,because of problems of cancellation in practice,there are more voices of abolishing cancellation system.Based on problem analysis,the paper tries to work out some solutions.
