| 摘 要： | 《刑法修正案（八）》增设了拒不支付劳动报酬罪.本文批驳了“拒不支付劳动报酬入罪有违刑法不得已性原则”的观点和“拒不支付劳动报酬的行为构成侵占罪或诈骗罪”的观点,解读了《刑法修正案（八）》关于拒不支付劳动报酬罪的规定,并提出了完善建议.

| Abstract: | The Criminal Law Amendment 8 makes an addition of the crime of ＂refusing to pay labor re- muneration＂. This article disagrees with the view that ＂the crime of refusing to pay labor remuneration is a- gainst the restraining of Criminal Law＂ and that ＂refusing to pay labor remuneration can be regarded as the crime of misappropriation or defrauding＂. This article strives to inspect the regulation of this crime in the Criminal Law Amendmeut 8 and tries to offer some suggestions for the specific implementations of the regu- lation. |
