| 摘 要： | 通过对西方主流社会结构理论的反恩,提出法律秩序场域下的社会结构在宏观上与物质生活关系具有因果优先性,在微观上具有网络特性并以此缩减复杂性.因之,在社会结构与法律秩序的互动关系研究中,对西方社会结构理论不能是"前反思性的接受",而应充分考虑历史可能性和当下的时代限度,结合本土化特征,实现反思性地借鉴和吸纳.
