| 摘 要： | 教唆犯是以教唆他人犯罪这种独特的方式参加共同犯罪活动的。以往对教唆犯的研究大多停留在注释刑法学的层面上。本文立足共同犯罪，着重对教唆犯的概念和成立要件从应然的角度作了较为深入的探讨。
