试论推进精神文明建设法制化

作者运用马克思主义辩证唯物论观点, 论证精神文明建设与法制建设的科学内涵及其辩证关系, 推进精神文明建设法制化的措施、目的和意义, 并且认为在推进精神文明建设法制化过程中, 必须正确认识和处理依法治国与以德治国、权力意识与法律意识、自律与他律以及柔性疏导与刚性制约等关系。这是精神文明建设走向法制化亟需解决的新课题。它对于在新的世纪促进两个文明建设, 解决“一手硬, 一手软”问题, 从“人治”走向“法治”, 并使法治与德治有机结合、相互促进, 最终实现社会主义现代化建设目标有着重要的现实意义。

Trial Discussion About Advancing Legal System of Mental Civilization Construction

The author utilizes the dialectical materialism viewpoint of Marxist to prove the scientific connotation and dialectical relation of mental civilization and legal system construction in order to advance the measure,aim and singnificance of mental civilization and legal system construction,and considers that we must correctly understand and handle the relationships of administering a country according to the law and virtue,power and law consciousness,self-disci pline and being disciplined by others,gentle and agreeable guidance and rigid restriction when we advance legal system of mental civilization construction.It is necessary to solve a new problem when the mental civilization construction moves towards legal system.It has the important and practical significance in promoting two civilization constructions,solving the problems of a soft-hand and hard-hand,from rule by man to rule by law,combining rule by law with rule by virtue,promoting each other,and finally realizing the aim of socialist modernization construction in the new century.
