建立复合型体育仲裁制度的探讨

目前,我国的体育仲裁制度尚未完全建立,体育运动在市场经济的影响下出现了诸如违反公平、技术争议、人身伤害和合同权益等竞赛和非竞赛性纠纷.现今体育规则中单一的竞赛仲裁条款不能为其纠纷的调解提供合理的仲裁,也很难适应体育运动的发展.只有建立由仲裁、司法程序所组成的复合仲裁调解机制才能够合法、完善地对体育运动纠纷给予规范裁决.这也是体育运动走向世界与国际奥委会接轨的必要法制化保障.
