| 摘 要： | 法律经济分析（EAL）进入中国已近二十年，这一新兴领域内产生的效果不容否定。但表面的繁荣不能掩盖其未来发展所存在的危机。本文结合交通法规中有关“撞了白撞”条款产生的争论，试图揭示法律经济学在中国发展的误区，并提出经济学分析和中国法学研究相融合的可行之道。

| Abstract: | Economic analysis of law(EAL) has been introduced into China for nearly twenty years and has produced undeniable fruits. However, there exists crisis in the future development of EAL under the surface of its success. The aims of this article are to disclose the problems of the development of EAL in China and to propose the proper way of uniting EAL and jurisprudence of China. |
