中国传统伦理的法律表达

以农业为主的生活环境与生存状态造就了中国传统伦理的和谐追求、群体本位、等级伦理的精神特质。为了追求和谐,司法中“无讼”追求便成为其实践模式;家族本位和国家本位的群体伦理决定了“重刑轻民”和“家法族规”法律体系;“贵贱有分,长幼有序”的宗法等级伦理则形成了“权利等差”的法律制度。只有深刻认识中国古代法律与伦理的内在关联,才能客观公允地对待中国传统文化,更为审慎地移植西方法律。

Only a profound understanding of ancient Chinese law and ethics internal re- lationship to objective and fair treatment of Chinese traditional culture, a more careful transplanting Western legal. Only when un- derstand profoundly the correlation between law and ethics of Ancient China, can we treat the traditional cultural of China imper- sonally and fairly, transplant western law extremely prudently.
