古代蒙古族社会规范考述

社会规范是人们社会行为的规矩和社会活动的准则。它是人类为了社会共同生活的需要,在社会互动过程中衍生出来的相习成风、约定俗成,或者由人们共同制定并明确施行的。本文运用法社会学与民族法学研究方法,对蒙古古代历史上具有准法律意义上的忽里勒台制、氏族别乞制、祖先祭祀制、血亲复仇制、结安达与那可儿制与婚姻家庭财产继承等问题进行了考述。提出了这些社会规范对蒙古民族自身的发展与民族共同体的形成,国家的产生和制度的完善以及社会控制方面起到了非常重要作用的观点。

The social norm is the social behavior customs and the social activity criterions.It faces the need for living together of the society. It developed from the interaction of tradition and contraction or regulated and observed by people . This article use Sociology and National jurisprudence methods, to research the ancient Khuraldai system, the Behi system, the ancestor worship system, the blood vengeance system, the knot Anda and Nkhur system, the Marriage and Family Inheritance in Mongolia history to rise that these social norms of the Mongolian nation＇s own has played a very important role in the development and the formation of a national community, the Country＇s production and improvement of system and the social control.
