| 摘 要： | 我国现行刑法典中没有关于环境犯罪危害犯的规定。但是，环境立法价值取向的转变以及环境犯罪特点决定了确立环境犯罪之危险犯的必要性。本针对这一现状，在正确界定环境犯罪危险犯的概念与特征的基础上，对其分类中有争议的问题进行了探讨。
