| 摘 要： | 以霍姆斯的《普通法》和卡多佐的《司法过程的性质》为素材,对自霍姆斯以来形成的实用主义司法哲学中法律与道德、法官个人道德与主流道德等问题进行探讨。揭示普通法和实用主义法学中丰富的法律哲学和司法哲学思想,分析我国当今司法中的若干问题。
