| 摘 要： | 物权变动具有形式主义与意思主义模式。我国物权变动立法采取二元化模式,使交易主体不被强制遵循单一的变动模式,避免了形式主义的模式化,物权流转更具灵活与效率性。实现效率原则,物权变动予以公示弥补信息的失灵,完善不动产登记制度提高效率,完善信息查询制度降低成本。

| Abstract: | Formalism and intentionalism are the two patterns of real right change.The dualistic pattern of the legislation of real right change in China allows bargainers not to follow the sole change pattern,avoids the patternization of formalism and makes the spread of real right more flexible and efficient.To realize the efficiency principle,we should publish notification of real right change to make up the information failure,prefect the real property registration and the information investigating system to improve efficiency and reduce costs. |
