| 摘 要： | 本文认为生育权侵权可以分为外部侵权和内部侵权两大类，并联系实际分析了生育权侵权的具体形式，探讨了生育权侵权的构成要件及其抗辩事由，最后依据现有法律规定，笔者提出了对生育权侵权的法律救济方式。

| Abstract: | This text think the infringe to childbirth right can divide into two big class, i.e. outside infringe and inside infringe, relating facts, I analyzed the specific forms of the infringe to childbirth right , discussed the element and contradiction sakes of the infringe to childbirth right finally, according to the legal rules, I put forward the legal remedy of infringing to the right of childbirth. |
