| 摘 要： | 文章从高校与学生之间的现状出发,以分析学生诉高校等相关案例为视角,在梳理分析现有高校与学生之间法律关系的观点基础上,借鉴有关理论的合理因素,界定高校与学生之间的法律关系应该是一种基于教育、管理、服务事实而形成的、以宪法法律关系为基础的,以行政法律关系为主、兼具民事法律关系特点的三重法律关系。

| Abstract: | This article is starting from China's present situation between universities and students, and is based on the analysis of litigation and other related cases in Colleges and universities, on the basis of analyzing the legal relationship between universities and students to the current view, used the reasonable factors related theory. The legal relation between universities and students should be a kind of triple legal relationship which is based on the fact of education, management, service, on the basis of the constitutional legal relationship, give priority to with administrative legal relationship, with the characteristics of the civil legal relation. |
