| 摘 要： | 仅仅明确法与道德的静态关系是不够的。如何运用法与道德的静态关系原理去解释并解决现实生活中关于法与道德的矛盾冲突至为重要。道德指导立法并体现于立法之中。司法应当具备更高的的道德素质。但在法律适用过程中一般应当排斥道德的作用。法律化的道德原则的适用应当遵循严格的具体规则。

| Abstract: | It's not adequate only to define the static relationship between law and morals. It's crucial to explain and resolve the realistic contradiction between laws and morals by applying the theory of their static relationship. Morals direct legislation and are embodied in legislation. The judge should possess better morality quality, but the impact of morals usually should be eliminated from the application of law. The application of moral principles specified in the law should strictly follow the specific rules. |
