| 摘 要： | 在我国现阶段市场经济条件下，由于不能预见的经济情事发生，如继续执行原合同或协议，可能使无过错一方当事人遭受不应承担的巨大损失，而另一方却在没有付出相应对价的情况下，可能意外获得巨大利益，违背了诚实信用及公平原则。因此，确立和正确适用情事变更原则，对保护当事人合法权益，维护市场经济秩序有着重要意义。

| Abstract: | Some unforeseen events often happen under the present situation of economical market.In such cases,if the original contracts or agreements continue, the innocent party may get a big unexpected profit without paying any suitable cost. It uiolates the principle of honest credit and justice. So it is important to set up and apply properly the principle of changeable event to protect the clients' legal right and keep the market in an economic order. |
