| 摘 要： | 格式条款本身是个舶来品,是随着资本主义的产生和发展而在资本主义国家成长起来并得到广泛运用的。格式条款的大量使用,使经济强者在“契约自由”的幌子下迫使经济弱者接受不公平的合同条款。在这种情形下,如何以法律的手段对格式条款进行规制,以实现社会公正,即系一典型新课题。针对这一问题,本文拟以电信合同为例作初步的探讨。

| Abstract: | Standard terms are from abroad.With the development of capitalism,standard terms have been widely used in developed countries.So the customers have to accept these unfair terms in trade.In this circumstance,how to regulate standard terms legally is a very important question and a new field.This paper discusses the problem with telecommunication contracts. |
