| 摘 要： | 可持续发展观和公平正义理论是环境法的两个理论基石。可持续发展是环境法存在的目的，是法律坚持以人为本的结果。而公平正义问题又是环境法价值目标的核心内容，也是其进行整个制度设计的重要理论基石。
