| 摘 要： | 本文着重分析了罪犯劳动改造的功利主义思想背景以及受这种功利主义指导的刑法一般预防、个别预防观念.另外还从公众认同、国民欲求、经济因素三方面论证了劳动改造在当前中国的话语背景.但要防止功利成为公害,为此必须有一种具有普世的底线伦理的制约.

| Abstract: | This article analysed the emotional background of utilitarianism in the labour transformation of criminals, and the conception of general protection and individual protection in capital law under the direction of utilitarianism . In addition, discussed the current vocabulary background of labour transformation. There must be the limit of an overall bottom normality to protect utilitarian from changing into scocial harm. |
