| 摘 要： | 劳动教养制度不适应依法治国基本方略的要求,不仅存在明显的宪法性根据问题,而且有关劳动教养制度的法规之间或者其他规范性文件之间,都存在明显的矛盾和冲突。因此,改革劳动教养制度势在必行。

| Abstract: | The system of the physical labor correction has not adapted to the general demand of managing the state by law, in which there is an obvious doubt if the constitution basis exists, and there are self-contradictions and conflicts between the regulations as well as the other standard documents. It is the high time to reform the system of the physical labor correction. |
