论经济法产生的时间

经济法学者对经济法的产生时间存在分歧，可以分为两类观点：一类观点认为产生于古代社会；另一类观点认为产生于资本主义阶段。笔者认为经济法作为一个法律部门产生于古代社会。因为经济法产生的含义就是指经济法律部门的产生，但经济法律文件、经济法律规范与经济法律部门是同时产生的。经济法产生不以生产社会化或垄断的出现为前提，国家社会经济职能是国家固有的，从国家产生就具有，并不是以后才具备的。经济法体系中所包括的一些法律子部门在古代社会就已经产生了。

Discuss on the time of economic law's emergence

There is difference on the time of economic law 's emergence among scholars on economic law. There are two kinds of view. Some scholars think that the time economic law coming into being is ancient society, while some other people believe that it is capitalism society. As far as I am concerned, I agree with the first opinion. First, the meaning of economic law 's emergence is economic legal branch's emergence, but economic legal branch, economic legal document and economic legal norm come into being at the same time. Second, socialization of production or monopoly's emergence isn't the premise of economic law's emergence, country's function on society and economic is innate in the country, it comes into being with the born of country. Third, some grandson legal branch of economic law had existed in ancient society.
