| 摘 要： | 侦察阶段，由于权利和权力设计的不平衡，在诉讼攻防活动中，犯罪嫌疑人成了最易受侵害的人。文章通过对防御权存在的根据，国际通行的防御范围的探讨，针对刑事司法实践中存在的问题，提出了扩大并保障犯罪嫌疑人防御权的设想。

| Abstract: | Because the design of right doesn't balance with that of pawer in the period of investigation,the criminal suspect will become one who is easiest to be hurt ie the activiey of the attack and defence.This thesis makes an inquiry into the basis og defence existence and the eaege of defence which is used in the word commonly.To counter these problems exsited in practicce,an assumption has been suggected about enlarging and protecting defensive right. |
