| 摘 要： | 优先购买权制度是一项古老的民事法律制，至今仍被许多国家所承认。我国立足于现实经济生活的需要，已规定了几种类型的优先购买权，但这些规定多是原则性的，概括性，操作性不强，因此，我国应在肯定既有立法的基础上，借鉴国外立法，完善我国的优先购买权制度。

| Abstract: | Preemption right system is a traditioal system in civil laws and is still agreed on by many countries.This article studies the history of the system's development,analyzes the functions of preemption right and reveals the immediate significance of the system in society of market economy.According to the practical needs China has set up some types of preemption right but these regulations are mainly too general and of weak realizbility.We should learn from the examples of foreign legislation fo perfect the preemption right system of china. |
