| 摘 要： | 亲属扶养制度历来都是有关亲属立法的重要内容。扶养制度既具有法律性叉具有道德性的二重性决定了立法对扶养制度的界定，不仅仅局限于禁止、制裁、处罚手段，更多的还应是一种倡导、鼓励、预防的手段。
