| 摘 要： | 本文借助于委托代理的基本理论，分析了我国公共委托中的委托代理关系，推理出我国公共委托责任中委托方与代理方的特点以及委托方意志被弱化、代理方一直缺乏有效约束的原因，并结合我国现有的实际情况提出了应对之策。
