隋朝法制与隋朝兴亡的辩证统一--从《开皇律》修定及其实施谈起

仿北齐律的结构，《开皇律》确立并完善了封建刑律的十二篇体制，删除了北周不少苛酷的刑罚内容，标志着封建刑罚制度趋于成熟，很好地维护了封建宗法关系，有效地巩固了封建皇权与封建国家的统治，为隋初的社会兴盛和国家统一起到了关键性的作用，并直接影响到唐代。隋帝统治后期和隋炀帝在位期间以法坏法、有法不依、滥用酷刑，使自己制定的良法如同具，进一步激化了社会矛盾，加速了隋王朝的灭亡。

Dialectial Unity of Legality and Rise and Fall in the Sui Dynasty --Talking from the Revision and Practice of Kaihuang Lü

Following the system of Beiqi Kaihuang Lu,it establishs and perfects 12 pieces of systems about feudal criminal laws, deleting a lot of severe punishments. It marks the rape of feudal imperial power and imperial country. It has crucial affection to make the country unit and affect Tang Dynasty. During the later stage of Emperor Sui wendi or the ruling of Emperor Sui Yangdi, the rulers violates the law, destroys the law and abuses the cruel torture. It makes good laws mere formality, which sharpens the social contradiction further and accelerates the extinction of Sui imperial court.
