| 摘 要： | 理论上的不足往往是由实务界首先发现的。一起特殊的遗产纠纷案件使我们聚焦民法的“魔法条文”—%D公序良俗原则。本文认为 ,作为一个极度抽象的民法基本原则 ,不能直接适用于个案 ,只有通过一定程度的具体化 ,取得实际的法条形式 ,具有了可含射案件事实的规则特质 ,才能适用于具体案件。否则 ,可能引起司法上的混乱 ,损害民法的基本价值理念 ,侵犯人的基本自由。 |

| Abstract: | The public-order-and-kind-custom is a significant institution of the modern civil law, embodies the personal interests submitting to social public order, and greatly influences on constructing modern social civilization. The author elaborates the concepts and the functions of the principle of the public-order-and-kind-custom, points out that it must be used in the jurisdictional practical after being concreted to some degree;otherwise it maybe leads to the chaos in the jurisdictional fields,and it also can destroy the basic values of civil law and infringe the basic rights of human beings. |
